1. Acceptance of terms
By booking, purchasing, attending, participating in, or using any Fit In 20 EMS service, session, membership, package, promotion, event, website, or facility, you agree to these Terms & Conditions.
Participants must be at least 13 years of age.
Participants under 18 years of age require written consent from a parent or legal guardian.
Participants under 16 years of age must be accompanied by a parent or legal guardian during training sessions.
2. Memberships and packages
Fit In 20 EMS offers memberships, session packages, promotional offers, and complimentary trial sessions.
Monthly memberships automatically renew and continue on a month-to-month basis unless cancelled with at least thirty (30) days written notice.
By enrolling in a monthly membership, you authorise Fit In 20 EMS to automatically charge your credit card, debit card, or other approved payment method on file each month until your membership is properly cancelled.
10-session packages expire six (6) months from the date of purchase. Any unused sessions remaining after expiration are forfeited and are non-refundable.
Unused sessions are non-refundable, non-transferable, and have no cash value.
Fit In 20 EMS reserves the right to modify membership pricing, package pricing, and services with reasonable notice.
3. Scheduling and cancellations
Sessions must be scheduled in advance and are subject to availability.
Fit In 20 EMS recommends a minimum recovery period of 72 hours between EMS sessions and reserves the right to limit booking frequency when deemed necessary for safety reasons.
Appointments must be cancelled at least three (3) hours before the scheduled session time.
Sessions cancelled less than three (3) hours before the scheduled appointment or missed without notice will be considered used and will not be credited back to the member's account.
Fit In 20 EMS reserves the right to waive cancellation penalties in emergency situations at its sole discretion.
4. Payments
You authorise Fit In 20 EMS to charge your payment method on file for membership dues, session packages, retail purchases, late cancellation fees, declined payment fees, and any other authorised purchases.
Members are responsible for maintaining valid and current billing information at all times.
If a payment is declined, returned, expired, or otherwise cannot be processed, Fit In 20 EMS reserves the right to suspend services and membership benefits until the account balance is paid in full.
Returned or declined payments may be subject to a fee of up to $10.
All sales are final. Membership fees, session packages, retail purchases, promotional purchases, and gift certificates are non-refundable except where required by law.
5. Membership cancellation
Membership cancellation requests must be submitted in writing via email to:
A minimum of thirty (30) days written notice is required.
Membership fees charged before the effective cancellation date are non-refundable.
6. Membership freeze
Memberships may be frozen for medical reasons, travel, or other circumstances approved by management.
All freeze requests must be submitted in writing and approved by Fit In 20 EMS.
7. Member responsibilities
Members are responsible for maintaining accurate contact information, billing information, and health information.
Members agree to promptly notify Fit In 20 EMS of any changes that may affect participation, safety, or membership status.
8. Health and safety
EMS training involves physical exertion and carries inherent risks.
You agree to disclose any medical conditions, injuries, surgeries, medications, or health concerns that may affect your ability to safely participate.
You agree to immediately notify Fit In 20 EMS of any changes in your health condition.
Members agree not to attend sessions while experiencing symptoms of illness, fever, contagious disease, or any condition that may pose a risk to staff or other members.
9. Medical disclaimer
Fit In 20 EMS does not provide medical advice, diagnosis, treatment, or healthcare services.
All information provided by Fit In 20 EMS, its trainers, employees, or representatives is for fitness and educational purposes only and should not replace professional medical advice.
You should consult your physician before beginning any EMS training program.
10. EMS training restrictions
Participation may be restricted or prohibited for individuals with certain medical conditions, including but not limited to:
- Pregnancy
- Pacemakers or implanted electronic devices
- Epilepsy
- Active cancer
- Recent surgery
- Acute infections
- Severe cardiovascular conditions
- Untreated hypertension
- Hernias
- Certain neurological disorders
- Any condition determined by Fit In 20 EMS to make participation unsafe
Fit In 20 EMS reserves the right to require physician clearance prior to participation.
11. Hydration and recovery
Members acknowledge the importance of proper hydration and recovery before and after EMS sessions.
Members agree to follow trainer recommendations regarding hydration, nutrition, recovery periods, and training intensity.
12. Assumption of risk
You understand and voluntarily accept all risks associated with EMS training, including but not limited to:
- Muscle soreness
- Muscle strains
- Joint injuries
- Falls
- Cardiovascular events
- Aggravation of pre-existing conditions
- Rhabdomyolysis
- Permanent disability
- Death
You voluntarily assume all risks associated with participation in EMS training.
13. Release of liability
To the fullest extent permitted by law, you release and hold harmless Fit In 20 EMS, its owners, employees, trainers, contractors, agents, and affiliates from any claims, injuries, losses, damages, costs, or liabilities arising from participation in EMS training or use of studio facilities.
14. Limitation of liability
To the fullest extent permitted by applicable law, Fit In 20 EMS shall not be liable for any indirect, incidental, consequential, special, or punitive damages arising from participation in its services.
15. No guarantee of results
Fit In 20 EMS does not guarantee any specific fitness, weight loss, body composition, muscle gain, strength, health, or wellness results.
Individual results vary based on attendance, effort, nutrition, recovery, medical conditions, and lifestyle factors.
16. Emergency medical care
In the event of an emergency, you authorise Fit In 20 EMS and its staff to obtain emergency medical assistance on your behalf.
You accept responsibility for any resulting medical expenses.
17. Photography, video, testimonial, and marketing release
By attending sessions, classes, events, or activities at Fit In 20 EMS, you grant Fit In 20 EMS permission to photograph, video record, and use your image, likeness, voice, testimonials, reviews, and recordings for promotional, advertising, educational, and marketing purposes.
Materials may be used on the Fit In 20 EMS website, social media platforms, email communications, digital advertising, printed materials, and other marketing channels without compensation or additional approval.
By accepting these Terms & Conditions, you expressly authorise such use.
This authorisation shall remain valid indefinitely unless revoked in writing and shall apply to content created before such revocation.
If you do not wish to have your image or likeness used, you must notify Fit In 20 EMS in writing prior to participating in any session or event.
18. Communication consent
By providing your phone number and email address, you consent to receive appointment reminders, membership notifications, service updates, and promotional communications from Fit In 20 EMS by email, phone, and SMS.
You may opt out of marketing communications at any time.
19. Privacy
Fit In 20 EMS collects personal and health-related information solely for scheduling, membership administration, billing, communication, safety screening, and operational purposes.
Information may be shared with trusted service providers, including Mindbody, Stripe, payment processors, email providers, SMS providers, and other vendors necessary to operate the business.
Health-related information provided by members is used solely to determine eligibility and safety for EMS training.
20. Personal property
Fit In 20 EMS is not responsible for lost, stolen, or damaged personal property brought into the studio.
21. Right to refuse service
Fit In 20 EMS reserves the right to refuse service, suspend participation, cancel appointments, or terminate memberships when participation is deemed unsafe, inappropriate, disruptive, abusive, or in violation of studio policies.
22. Force majeure
Fit In 20 EMS shall not be liable for delays, interruptions, cancellations, closures, or inability to provide services due to circumstances beyond its reasonable control, including severe weather, power outages, equipment failures, natural disasters, public health emergencies, pandemics, government actions, labour disputes, or other unforeseen events.
23. Governing law
These Terms & Conditions shall be governed by and interpreted under the laws of the State of Illinois.
24. Arbitration
Any dispute arising out of or relating to these Terms & Conditions or participation in Fit In 20 EMS services shall be resolved through binding arbitration in the State of Illinois, except for matters eligible for small claims court.
25. Severability
If any provision of these Terms & Conditions is found to be invalid, illegal, or unenforceable, the remaining provisions shall remain in full force and effect.
26. Changes to terms
Fit In 20 EMS reserves the right to update or modify these Terms & Conditions at any time.
Updated versions will be posted on the Fit In 20 EMS website and shall become effective upon posting.
27. Acceptance
By booking, purchasing, attending, or participating in any Fit In 20 EMS service, you acknowledge that you have read, understood, and agree to these Terms & Conditions.
